These Terms of Service ("Terms") are a legal agreement between you and WISELOOK TALENT LAB, S.L. ("Wiselook", "we", "us", "our"), with registered address at Paseo de la Castellana 42, 1st floor, 28046 Madrid, Spain, and tax ID B22539084. Contact: hello@wiselook.ai.
By accessing or using the Wiselook platform, applications and websites (the "Service"), you agree to these Terms. If you do not agree, please do not use the Service.
1. Who these Terms apply to
These Terms apply to:
- Assessed individuals, who take an assessment through the Service.
- Website visitors to wiselook.ai and its sub-domains.
Where an organisation (a "Business Client") has invited you to take an assessment, that organisation will have its own contract with Wiselook. These Terms do not govern that separate commercial relationship, but they do apply to your use of the Service as an individual user.
2. The Service
The Service is a platform for conversational competency assessments assisted by artificial intelligence and reviewed under our internal quality-control procedures.
The Service is intended as a professional development and talent-evaluation tool. It is not medical, clinical, diagnostic, legal, financial or psychological advice, and it should not be used as a substitute for any of those.
3. Eligibility and accounts
To use the Service you must:
- Be at least 14 years old. If you are between 14 and 18, you must have permission from a holder of parental responsibility or be acting in a context (for example, an educational programme) where that permission has been secured.
- Have the legal capacity to enter into binding agreements.
- Provide accurate registration information and keep it up to date.
- Keep your access credentials confidential and notify us promptly of any unauthorised use.
You are responsible for activity that occurs under your account.
4. Access to assessments
Registration on the Service is generally available, but registration alone does not entitle you to take any specific assessment. Access to an assessment typically requires an invitation from a Business Client that has engaged Wiselook for that purpose.
We may, in the future, offer assessments directly to individuals on a paid or freemium basis. If we do, additional terms — including pricing, billing and any applicable consumer-protection rights such as the statutory right of withdrawal — will be presented to you before you commit to that offering.
5. Licence terms
5.1. Our licence to you
Subject to your compliance with these Terms, Wiselook grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for its intended purpose.
This licence does not transfer any ownership of the Service or any of its components to you.
5.2. Your licence to us
To enable us to provide the Service, when you submit content (including responses, voice recordings, transcripts and any text you input), you grant Wiselook a limited, worldwide, royalty-free licence to:
- Process that content for the purpose of providing the Service to you and, where applicable, to the Business Client that invited you, including generating reports and outputs.
- Use irreversibly anonymised versions of that content to improve the Service, conduct quality reviews and engage in scientific research.
We do not acquire any further rights over your content. In particular, we do not use it to train third-party models, we do not sell it, and we do not license it to third parties for their own purposes.
6. Acceptable use
When using the Service, you agree to:
- Provide your own genuine responses. Do not impersonate others, submit responses generated automatically by other tools, or otherwise distort the assessment.
- Not include in your responses personal data of third parties (e.g., colleagues, family) or special categories of data (such as health, political, religious or sensitive personal information) that is not strictly necessary.
- Not use the Service for any unlawful, harmful, abusive, defamatory, or fraudulent purpose, or to infringe the rights of others.
- Not interfere with the Service's operation or security, attempt to gain unauthorised access, perform scraping, reverse engineer, decompile or otherwise attempt to derive the underlying methodology, models, or know-how, except to the extent such restriction is prohibited by applicable mandatory law.
- Not use the Service, or any output of the Service, to build, train or improve any competing product or service.
We may suspend or terminate access if you breach these rules, in particular where the breach is serious or recurring.
7. Intellectual property
All rights, title and interest in and to the Service — including the underlying technology, models, methodology, prompts, scoring logic, user interface, designs, trademarks, logos, documentation and the format and structure of any reports generated — are owned by Wiselook or its licensors and are protected by intellectual property laws.
You retain ownership of the original content you submit. The licence you grant under Section 5.2 is the only right Wiselook has over your content.
Any feedback or suggestions you choose to share with us about the Service may be used by us without restriction or compensation, and without creating any obligation on our part.
8. Outputs of the Service
The Service produces outputs (scores, indicators, qualitative descriptions, reports) that are probabilistic in nature. They reflect a model's interpretation of your responses within the scope and context for which the Service has been designed and validated.
You acknowledge and agree that:
- Outputs are decision support, not decisions. They are intended to inform human judgement, not to replace it.
- Outputs may not be accurate in every individual case and should not be treated as definitive statements about you.
- Wiselook makes no warranty that outputs will be suitable for any specific purpose, including any particular hiring, promotion, evaluation or admissions decision. Such decisions are made by the Business Client or other third party that uses the outputs, under its own responsibility.
- Outputs should not be used in ways that produce legal effects on individuals, or significantly affect them in similar ways, on the basis of solely automated processing.
9. Service availability and changes
We strive to keep the Service available and working properly, but we do not guarantee uninterrupted or error-free availability for individual users. The Service may be temporarily unavailable for maintenance, updates or events beyond our reasonable control.
We may modify, add, or remove features of the Service at any time. Where a change materially reduces functionality you actively rely on, we will provide reasonable notice through the Service or by email.
10. Suspension and termination
You may stop using the Service and request the deletion of your account at any time by writing to privacy@wiselook.ai.
We may suspend or terminate your access to the Service if you breach these Terms, if we are required to do so by law, or if continued provision of the Service to you would create a material risk to Wiselook, its users or third parties.
Termination does not affect rights and obligations that, by their nature, are intended to survive — including intellectual property, the licences granted in Section 5.2 over content already processed, disclaimers, limitations of liability and the governing-law provisions. The handling of your personal data after termination is governed by the Privacy Policy.
11. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable mandatory law, including the consumer-protection rights granted to you by Spanish and EU law if you act as a consumer.
12. Limitation of liability
To the maximum extent permitted by applicable law:
- Wiselook will not be liable for indirect, consequential, special, incidental or punitive damages, or for loss of profits, revenue, opportunity, reputation or data, arising out of or in connection with your use of the Service.
- Wiselook will not be liable for the decisions or actions taken by any Business Client, employer, educational institution or other third party on the basis of the outputs of the Service.
Nothing in these Terms limits or excludes Wiselook's liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable mandatory law. If you act as a consumer, you retain all rights granted to you by Spanish and EU consumer-protection law, which prevail over any provision in these Terms that would conflict with them.
13. Privacy
Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms by reference. By using the Service you acknowledge having read it.
14. Changes to these Terms
We may update these Terms to reflect legal, technical or business changes. Where the changes are material, we will inform you with reasonable advance notice through the Service or by email. The updated Terms will be effective as of the date stated at the top of the document.
If you do not agree with the updated Terms, you may stop using the Service and request the deletion of your account before they take effect.
15. Governing law and jurisdiction
These Terms are governed by the laws of Spain, without regard to its conflict-of-laws rules.
Any dispute arising out of or in connection with these Terms will be submitted to the courts of the city of Madrid (Spain).
If you act as a consumer, the previous paragraph does not deprive you of the protection afforded to you by mandatory provisions of the law of your country of habitual residence, and you may bring proceedings in the courts of that country in accordance with Regulation (EU) No 1215/2012.
If you act as a consumer resident in the European Union, you may also submit any dispute relating to the Service to the EU online consumer dispute resolution platform maintained by the European Commission, available at https://consumer-redress.ec.europa.eu/.
16. Miscellaneous
Entire agreement. These Terms and the documents they reference (including the Privacy Policy) constitute the entire agreement between you and Wiselook in relation to the Service for individual users.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganisation or sale of assets.
